Seviercorruption.com has gotten copies of emails that show Cheryl Houston has lied.  It is reported that she has said that she never told Commissioner Max Watson that he as a County Commissioner, would have to pay for the Crescent Printing file a few months ago when he made the request for the file.  Her conversation was recorded.  Now why would Ms Houston Lie?  Below are more emails that involve the same issues discussed in previous articles.  Hope you enjoy seeing public officials put their own head in a noose! 

Maybe Lying Larry will run crying to the Steering Committee and get the rules changed again to reflect the "law as he knows it."

My understanding is that County Commission has adopted rules relating to the retrieval of archived records not public documents that have not been sent to archive.

Below is the 1st reply from Ms. Butterworth.  She failed to address your position of charging a County Commissioner and is being asked again to reply to that portion of the request.

Please reply to my emails as I will persist until you do and if necessary escalate this situation as far as necessary under the applicable law.  Feel free to check my history when dealing with public officials who refuse to comply with the law.  Many have tried, some have lost their jobs and I always succeed in my goals by perseverance.

Just look at what Larry is going through now because he is so arrogant that he thinks he need not follow the rules.  What will he do when court action ensues due to his following the law, AS ONLY HE KNOWS IT!

The Tennessee Public Records Act (TPRA)(TCA Sections 10-7-501 et seq) provides for access by citizens of Tennessee to inspect public records during business hours, at no charge.  If rules and procedures are in place, then the request may be required to be put into writing (but the custodian or representative can complete the form if the requestor refuses or is unable to write the request). I am unaware of any legal basis for charging a "retrieval fee".  Please see the opinion of this office http://www.comptroller.state.tn.us/openrecords/Research.pdf  Even if copies must be made of a record in order to remove or redact confidential information, if you do not wish to take or keep the copy of the redacted record, you are not obligated to compensate the custodian for the production of that copy.  If you do wish to receive a copy of the document, the $.25 per page does not appear unreasonable.  Again, the fee should be established by rule previously adopted and the fee based on actual costs of producing the copy.  Note, when SB3280/HB3637 becomes law July 1, 2008, a records custodian will be able to charge for copies based on actual costs and for staff time that exceeds five (5) hours (based on hourly wage).
 
Note, the TPRA in TCA Section 10-7-503(a) provides that a custodian "shall at all times, during business hours, be open for personal inspection by any citizen of Tennessee, and those in charge of such records shall not refuse such right of inspection to any citizen, unless otherwise provided by state law." It is important to note that part of the responsibilities of a records custodian is to comply with the TPRA; failure to do so could subject the governmental entity to legal action.   See AG Opinion 06-069 regarding penalties for failure to comply. Also, see AG Opinion 01-021 which states:
No statute expressly requires a citizen to make an appointment in order to inspect public
records. If an agency required a citizen to make an appointment for this purpose, and the citizen challenged
such requirement in court, the court might not view the requirement as tantamount to a denial of access to
public records if the agency could articulate a reasonable basis for the appointment requirement. Absent
a reasonable basis for the requirement, a court could conclude that the agency was merely using it to delay
access.

Burgundy, that's the Color.  It took phone Calls to the supplier, but it is confirmed that the County purchased paint that is the same Colors as Uncle Jack's truck and Lying Larry's daughter.

Because that there is so much evidence of Corruption in the finicial records of the County and in order to prevent the release of those public documents, the Finance Department of the County is requiring the public and even some County Commissioners to pay for the information.  The State of Tennessee does allow local governments to make charges for Copies of public records but such a local act to do so has not been passed by County Commission  

The finance department, overseen by Cheryl Houston (Jim Ogle's latest flame) has been sent two different emails seeking clarification.  It is fact that Ms. Houston has quoted different prices to different people without authority to do so.  Some people acquiring public records have spent hundreds of Dollars.  CTAS has been contacted about the practice of charging County Commissioners for copies.   A CTAS spokes person said that they have never heard of such practice and indicated that it is improper to make Charges to the very people who are elected to oversee how our tax dollars are spent.

If you recall a couple of weeks ago we spoke about you providing me with records for purchases that the County has made from Volunteer Chevrolet.

While trying to obtain records from you, you have suggested that you may charge fees for the copy and release of those records.  I ask then and again now;  From where do you obtain the authority to charge for these records?  I am aware that the General Assembly has granted local Governments the privilege to make such charges if they adopt such practice.  I also interjected that I did not believe that you personally have such power unless granted that right by the County Commission.  I have asked you to provide me with the act taken by County Commission to levy such charges for public information.  Please provide.

I am not very pleased and feel that you have mislead me in an effort to suppress, if not all together prevent the release of public records.   That feeling is born by a reading of the forwarded email that I received.  In that communication as you will see you are attempting to levy charges to a seated County Commissioner.  You have told me that the fee for copies is .50 cents per page.  The email below says you have quoted .25 cents per page.  This leaves me to believe that you are arbitrarily and capriciously placing cost on copies for the release of public information.  I must ask, are there some who you make no charge on at all for copies?  Does Mayor Waters pay for copies he may request?

I am sending this communication to Ms Butterworth and ask that she use the power of her office to assist the Citizens and Elected Officials of Sevier County to obtain the proper timly release of public documentation and;

1.  Proof that proper authority has been granted your office to make charges for copies of public information by providing those written documents stating your authority.

2.  Assistance asking for assistance from other State Agency's into possible obstruction of justice charges as you have quoted two individuals two separate prices suppressing the release of public documents suppressing information which may show criminal activity.
 
Ms Butterworth please consider this an official request for assistance from your office.  Advise me of any possible steps that may be taken to obtain the requested information from Ms. Houston.  I ask both of you; Please reply to my request.

As you can see, copies of Commissioner Watson's email was sent to the precious Stan Voit, the sweetie that he is to Hossie.  Wonder if Good Low Stan thinks that it is proper to suppress a seated County Commissioner from having copies of our public records.  Maybe its the Ogle in Cheryl that makes her change her mind from Commissioner to Citizen.
Wonder when we will see those records and if Ms. Butterworth will assist us in our efforts to bring responsibility to our Government by exposing the Corruption that exist at all levels in the Courthouse.

You see that the very articles of foundation of this nation and The Great Emancipator reflect that the government serves the people and that there are times when the government must be changed in order to renew a democracy. We are united in our belief and efforts that what the Sevier County Mayor and County Commission are about to do is in violation of our Constitution and we will not stand by while our Rights and Liberty are usurped from us.

Preface: If you ask your County Commissioner about these connections of direct or family employment at County positions, don't take the answer that the jobs were acquired prior to being a County Commissioner.  Most of these fine upstanding people who are holding office got the jobs themselves or for their family member back then, just as jobs are given now.  It does not matter who the best qualified is, we got to give the job to a County Official or one of the already hired employees family member.  In other words, its who your daddy is that gets you in the Clique.

These guys may not have been elected then, but the conflict of interest existed then and still does today.  It should be abolished.  But you can count on one fact, each and every County Commissioner who falls into this category will have an excuse for validating this practice which in most all cases is corrupt.

Seviercorruption.com is sad to report that for almost a month we have been having technical problems.  We believe we got some really bad virus from some sender of an email.  We got our system checked and had 121 viruses.  Our system is now clean.  We wanted to post the new image of our Hoss 08 card as our new main image.  Unfortunately, our host informs us that they have problems on their end which is preventing us from posting it.  As soon as we can we will get the picture up for all to see.  Until then we will be back to reporting what the real news is around the County in our normal unbiased manner.

Today we tell of the Mother of one of our fine County Sheriff's Department officers and the conversation we had with her.  Having known this person all of this reporters life, when we saw her we wanted to give her one of the 5000 new cards we have printed that will be in your area soon.  Look for them in the produce area of your favorite market.  Most of the time in the Corn.  We have found that the Corn is the proper place for placement of our cards as they display our finest "Children of the Corn" on the backside.  Are you a child of the Corn?

Anyway, when we handed this officers mother a card we weren't treated so kindly until we started explaining why we are undertaking the task of letting the public know about the corrupt practices of our fine Sheriff.  We only had to tell her of Paul Lintner.  Until we told her of the faggot Hoss had working and fondling inmates, she had not been told or ever heard of the man and his conduct.  She was appalled.  Why had her son not told her?  Maybe he is in the closet along with alot of other officers at the SCSD.  That must be it.  Even though we now support "HOSS 08, Keep Corruption in office", we still won't go in that closet!

How many others have never heard of our fine Sheriff and his model employees?  We don't know.  But we are happy to be back informing you of what is happening around the County.  If you don't think the things we report here and worse are not happening under the control of HOSS 08, "Keep Corruption in Office" please vote to keep him in office.  Unfortunately, we here do have compassion for those being tortured in the Sevier County Jail.

Commissioner Gary Cole Admits why County Commission doesn't Care Who ate the Ribs.

First let us tell you that we hear that this months County Commission meeting has been canceled.  Lying Larry did it because he is getting some heat and does not want the public to know what is happening just before we go vote for sheriff next month.  I know, your saying; Lying Larry would never use his office for purely political reasons to protect a Homosexual.  As we have reported before, the sexual improprieties that occur at the Courthouse are countless and run through out the offices of our public officials.  Undoubtedly the problem is worse at the Jail because of the viability of fresh meat but things also happen across the street too. Just look into the District Attorney's Office.  He will know what we mean.  Those who prefer the alternative lifestyle should follow Hoss's lead and come out of the Closet.  How bout it Larry, is there anything you want to let us know before we post pictures?

It has been brought to the attention of Seviercorruption.com that County Commissioner Gary Cole admitted why the seventeen Commissioners who voted to change the rules in an attempt to prevent Max Watson from moving his resolutions forward.  One of which asks to find out:  Who ate the ribs?

Cole had a discussion with Clark King July 3rd at Mc Carters Market in Gatlinburg.  Although Cole tried to run away and avoid King's questions, when King pointed out he was a "Chicken Shit" as he tried to walk away, Cole turned and asked;  "Did you just call me a name."  To which King replied; "No I just called you what you are as you refuse to answer peoples questions who come to County Commission meetings and now you try to walk away from me.  You are an elected official and you are accountable to the public whether you like it or not."  Cole replied; "You people who come to County Commission are just trying to make some people look bad.  If you have a problem with Waters, you should go talk to him one on one."  King responded; "Oh, kinda like trying to talk to you today and for your information I have ask many questions at County Commission Meetings that have yet to be answeredIf you think that the people who are coming to Commission meetings are going away your wrong. Until Hoss answers the question of who ate the Ribs, I will never stop coming to the meetings. If there is nothing wrong with the rib purchases why has Hoss not told everyone who ate the ribs?" Surprisingly Cole replied but his answer was far from what you may expect. Cole said; "I have asked Hoss about the ribs and he showed me invoices that he says show he paid for his own ribs." King replied; I could care less about a receipt Hoss has that shows other purchases of ribs. I want to know who ate the ribs that the Jail purchased? To which Cole replied; "I don't care who ate those ribs." King then said; "So your telling me that when you are shown proof that questionable purchases were made by the Sheriff you will turn a blind eye. What your saying is you don't care what happens to our tax dollars after you approve the budget, then you want me to vote for a sales tax increase in August. Your out of your mind Gary. Why would anyone vote to increase their own taxes when you and your fellow Commissioners don't care what happens to the money after you pass the budget.  Its your job and some citizens are having to try and make you do it.  If you trim the fat from our County expenses, get centralized accounting as the Comptroller  has suggest year and year, we may not even need this tax increase. But if your only concern is getting your wife a County Job, then you like the rest are bought and paid for by those corrupt ******** in charge.

Cole left saying that King should seek election for County Commission next time.  To which King replied; "I might just do that I know I will kick your ass in a debate if you have the balls to debate me.  And in 2010 we will be using paper ballots, you'll not be able to program your desired outcome then."

That brings us to this. As long as we don't have a nepotism policy and we continue to have these thugs in office who think our County Government is their own private company, we will have the same problems that we have now.  Mainly, our county government is ran by Backward thinking people.  By people who have grown so accustomed to doing whatever they wish regardless of the rule of law that they think they are right.  Those type of people do not need any more taxes to spend.  After all, what is Sevier County trying to do, have the distinction of the highest sales tax in the State.  Get real, we don't need that with the struggling economy.  What we need to do is trim the fat from the County Expenses and lower the sales tax rate from where it is now. 

After all, if you kill the goose that laid the golden egg, you won't be getting any more eggs any time soon.

In closing, if we need a tax increase for the School System, lets look at how Curtis Henry got the G-P Job.  Don Best was given a newly created job at the Centeral office.  Was that position advertised?  Seviercorruption.com understands that not only was it not advertised, but the County had no problem coming up with the money to pay for that new position.  Do we really have a shortfall if we trim the fax and our corrupt officials are brought into line?  The answer; NO!
